Terms and Conditions
1. Scope of Application
1.1. These Terms and Conditions apply to all legal transactions and orders that consumers and business customers (hereinafter collectively referred to as "customers") conclude with Weingut Stift Göttweig GmbH via the online shop, by email, telephone, or through on-site sales.
1.2. Deviating, conflicting, or supplementary terms and conditions of customers shall not become part of the contract unless we have expressly agreed to their validity in writing.
1.3. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business customer is a natural or legal person who acts in the exercise of their trade, business, or profession when entering into a legal transaction.

3. Offer and Conclusion of Contract
3.1. The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.
3.2. By clicking the "Place Order" button, you submit a binding offer to conclude a purchase contract for the products in your shopping cart.
3.3. The contract is concluded by:
- Our express acceptance (e.g., order confirmation by email), or
- The actual dispatch of the goods.
An automatic confirmation of receipt by email does not yet constitute acceptance of the contract.
3.4. Availability: All offers are valid "while stocks last". Should a vintage be sold out, we reserve the right to contact customers and alternatively offer the following vintage or to withdraw from the contract and refund payments.
4. Prices, Discounts, and Shipping Costs
4.1. Prices: All prices in the online shop are stated in euros and include Austrian statutory value-added tax.
4.2. Volume Discounts: We grant the following discounts on the value of goods (excluding shipping costs):
- For purchases of 200.00 EUR or more: 5% discount
- For purchases of 300.00 EUR or more: 10% discount
4.3. Shipping Costs: Shipping costs depend on the delivery country.
- Austria: 6.00 EUR (free shipping for orders of 90.00 EUR or more)
- Germany, Czech Republic, Poland, Slovakia, Slovenia, Hungary: 12.00 EUR (free shipping for orders of 90.00 EUR or more)
4.4. Delivery to Other Countries: Deliveries to countries not listed are possible upon request at office@weingutstiftgoettweig.at. We will individually assess feasibility and shipping costs.
5. Delivery and Logistics
5.1. Delivery Area: We deliver as standard to Austria, Germany, Czech Republic, Poland, Slovakia, Slovenia, and Hungary.
5.2. Packaging Units: We ship our wines in shatterproof cartons (1, 3, 6, and 12 bottles). For quantities of approximately 60 bottles or more, deliveries are generally made by freight forwarder on half-pallets or by individual arrangement.
5.3. Delivery Time: Delivery time is typically 2–5 business days after receipt of order (or receipt of payment for advance payment), depending on delivery address and seasonal peak times.
5.4. Delivery Information: Please provide your telephone number when ordering. This will be passed on to the shipping service provider to announce delivery or clarify issues.
6. Transfer of Risk (Shipping Risk)
6.1. For Consumers: The risk of loss or damage to the goods only passes to the consumer when the goods are delivered to them or to a third party designated by them (who is not the carrier). We therefore bear the shipping risk.
6.2. For Business Customers: The risk passes to the business customer as soon as we have handed over the goods to the transport company (postal service, freight forwarder, parcel service).
7. Payment and Invoicing
7.1. The following payment methods are available in the online shop:
- Credit and debit cards (Visa, Mastercard, Maestro, Amex)
- Apple Pay / Google Pay
- Instant bank transfer (Klarna, eps)
7.2. For on-site purchases, we accept cash as well as debit and credit cards.
7.3. Invoice: You will generally receive your invoice electronically by email. Business customers requiring a separate company invoice are requested to contact us or note this during the ordering process.
7.4. The goods remain our property until full payment has been made.
8. Youth Protection
8.1. Wine and sparkling wine are only sold to persons over 16 years of age. Spirits are only sold to persons over 18 years of age.
8.2. By placing an order, customers confirm that they or the recipients have reached the legally required minimum age.
8.3. We reserve the right to carry out age verification through appropriate measures.
9. Right of Withdrawal for Consumers
9.1. Consumers have the right to withdraw from this contract within fourteen days without giving any reason.
9.2. Exceptions: The right of withdrawal does not exist for goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery (e.g., opened bottles).
10. Warranty and Wine Quality
10.1. The statutory warranty provisions apply.
10.2. Tartrate: The possible occurrence of tartrate (crystals in the bottle) is a natural phenomenon during wine maturation. It does not constitute a quality defect, but rather is a sign of natural production and does not entitle to complaint.
10.3. Cork Taint: Should a bottle of wine exhibit "cork" (TCA), we will replace it at our discretion or credit the value, provided that:
- The defect can be verified sensorially by us,
- The bottle is still at least two-thirds full and is returned to us sealed with the original cork.
10.4. Transport Damage: Obvious defects (e.g., broken glass, wet cartons) should please be reported and confirmed immediately with the delivery person. This helps us with insurance, but does not limit your statutory warranty rights. In such cases, please send us photos at office@weingutstiftgoettweig.at.
11. Liability
11.1. We are liable without limitation for damages resulting from injury to life, body, or health, as well as in cases of intent and gross negligence.
11.2. In cases of slight negligence, we are not liable to business customers. Towards consumers, liability for slight negligence is limited to typical and foreseeable damage under the contract (excluding personal injury).
11.3. The provisions of the Product Liability Act remain unaffected.
12. Data Protection
The processing of personal data is carried out in accordance with our privacy policy. We use your data (e.g., email, telephone number) exclusively for contract fulfillment (e.g., passing on to parcel service providers for delivery notification) or if you have expressly consented (e.g., newsletter).
13. Final Provisions
13.1. Applicable Law: Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence is not withdrawn.
13.2. Dispute Resolution: The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
13.3. Place of Jurisdiction: For business customers, the exclusive place of jurisdiction is the competent court for our registered office in Krems an der Donau.
